1. Identity of the Person Responsible for the File
Any information supplied by the User via any forms on the Website will be uploaded to one or more files being the party responsible MAKIBER S.A. (“MAKIBER”), whose registered office is at PASEO DE LA CASTELLANA 182, 28046 MADRID.
2. Purpose of processing
MAKIBER will process information provided by the User for different purposes, depending on how the data was collected:
- Managing a contractual or commercial relationship established between MAKIBER and the User.
- Providing services requested by the User.
- Managing, administering, providing and extending services that the User has subscribed or registered.
- Adapting such services to enhance their quality for the User.
- Designing new services related to the above.
- Performing statistical studies to improve the services provided.
- Sending information required by the User.
- Sending information on any changes related to the products or services contracted by the User.
- Sending information of new products or services that are similar to those originally contracted or that may be of any interest by any means, including electronically, even when the commercial relationship established between MAKIBER and the User ends.
As the User, you consent to the processing of your data for the purposes described, without prejudice to your right to revoke consent by sending an email to makiber@makiber.com, identifying yourself as a User of the Website and specifying your request, or alternatively by marking the relevant box provided on the form.
3. Recipients of the information
No data provided by the User to MAKIBER shall be communicated to any third party, unless:
- such assignment is authorised by law;
- any processing done is consistent with the free, legitimate acceptance of a legal relationship whose development, compliance and control necessarily involves associating such processing with third-party data, e.g., with banks for the billing of products or services contracted, or with courier services in order for the products contracted to be shipped; or
- the data is required by the Public Ombudsman, Department of Public Prosecutions, any court of law or the Accounts Tribunal in the exercise of their competence.
4. Compulsory or optional nature of the information requested
Any required fields on each form will be identified as such on the form itself.
Refusal to provide any such required information shall restrain the effectiveness of the service requested by the User.
5. Exercise of rights
As the User, you may exercise your rights of access, correction, cancellation and objection by email addressed to makiber@makiber.com, identifying yourself as a User of the Website and setting out the details of your request.
As the User, you may also exercise your rights of access, correction, cancellation and objection by post, addressed to Paseo de la Castellana 182, 28046, Madrid, identifying yourself as a User of the Website, enclosing a photocopy of your identity card or equivalent document, and setting out the details of your request.
6. User’s undertakings
As the User, you guarantee that you are at least 14 years old and that any information provided is true and accurate.
As the User, you undertake to inform MAKIBER of any changes in the information provided, by email addressed to makiber@makiber.com, identifying yourself as a User of the Website and specifying the details of the changes to be made.
You further undertake to keep any passwords or identification codes secret and promptly to report to MAKIBER any loss, theft or unauthorised access. Until such notice is received, MAKIBER shall accept no responsibility for any consequences of the improper use of such passwords and identification codes by unauthorised third parties.
7. Third-party data supplied by the User
If the User provides any third party’s personal data for any purpose, the User guarantees that those affected have been informed in advance and that their consent for their data to be forwarded to MAKIBER has been obtained.
As the User, you guarantee that you are at least 14 years old and that any information provided is true and accurate.
MAKIBER shall confirm the consent of such affected parties by means of an initial non-commercial email, requesting verification of the consent given on their behalf by the User.
If any liabilities ensue in respect of any breach of these conditions by the User, the User shall be liable for the consequences of such breach.
8. Cookies and monitoring files
The User accepts the use of cookies and files to monitor IP addresses, the use of which enables MAKIBER to compile data for statistical purposes, e.g., date of first visit, number of visits, date of last visit, URL and domain of origin, browser used and screen resolution.
As the User, you may prevent cookies from being generated by selecting the relevant option in your browser. However, MAKIBER accepts no responsibility if disabling cookies results in the Website not functioning optimally. The information obtained is completely anonymous and in no case may be associated with or identify any specific user.
9. Security measures
MAKIBER has applied the necessary technical and organisational measures to assure the security of personal data and prevent it from being tampered with, lost, processed or accessed without authorisation, considering the technology currently available, the nature of the data stored and the risks to which it is exposed, whether as a result of human action or physical or natural events.
Nevertheless, the User should be aware that no online security measures are absolutely unbreachable.
